Terms and conditions

§ 1 Scope of application

Engelmann Limousinenservice GmbH provides all passenger transport services and car trips exclusively on the basis of these general terms and conditions. These general terms and conditions also apply to all future business relations, even if they are not expressly agreed again.
At the latest with the use of Engelmann Limousinenservice GmbH services, the general terms and conditions are binding and accepted.

Deviating, conflicting or supplementary general terms and conditions of our customers or other third parties are hereby expressly excluded, unless there is an agreement in writing between the contracting parties regarding the deviation in question.

§ 2 Offer and conclusion of contract

The offers of Engelmann Limousinenservice GmbH are, insofar as nothing else has been agreed in writing, free and non-binding. Acceptance takes place either in written form or by the provision of the service to the customer.

The customer is responsible to ensure that all information necessary for the performance of the service, which he himself or another person submits to us in his name, is complete and correct.

§ 2.1 Online Booking Portal

For queries made online via our booking portal, the following provisions shall apply in addition to § 2:

The customer submits a non-binding inquiry to Engelmann Limousinenservice GmbH by submitting the completed form in our online booking portal. The purpose of this contract is to provide the service requested by the user.

Engelmann Limousinenservice GmbH will send the customer an automatic acknowledgment of receipt with the details of the service requested by e-mail. We only confirm the receipt of the customer's request.

The contract between Engelmann Limousinenservice GmbH and the customer for the desired service comes into effect only by means of the separate declaration of acceptance ("confirmation") by e-mail. Only then the customer is entitled to demand the service itself and to make further claims.

A right of revocation of the customer does not exist according to § 312b Abs. 3 point 6 BGB.

§ 3 Compensation and Payment

Unless otherwise agreed in writing, the compensation claim of Engelmann Limousinenservice GmbH is stipulated in the contract.

§ 3.1 Travel changes

In case of a spontaneous change of the journey at the request of the customer or passenger, the actual service will be recalculated and priced according to the current price structure after completion of the journey.

The tours / hourly bookings begin at the booked pick-up time and must always end in the city area of the pick-up location. In the case of a different destination, the journey ends with the arrival of the driver at the starting address.

§ 3.2 Waiting time

In the case of one-way transfer services, the waiting times for airport pick-ups are free of charge for up to 60 minutes after the agreed pick-up time. Delays or earlier flights will result in a shift of this pick-up time. In all other cases 15 minutes of waiting time after the agreed pick-up time are free of charge.

After the expiration of the free waiting time period, 25% of the hourly booking rate of the selected vehicle category and any additional parking fees will be charged for every started 15 minutes waiting time.

§ 3.3 No-shows

A ride is considered as a no-show if the customer has not shown up at the agreed pick-up location at the agreed pick-up time and was not reachable within the free waiting time. No-shows of one-way transfer services are to be paid for in full, for tours / hourly bookings the first hour of the chosen vehicle category will be fully charged. There are no surcharges for the waiting period in the case of a no-show.

§ 3.4 Terms of payment for one-way transfer services

When booking a one-way transfer service, the customer receives the invoice with the confirmation by e-mail.

The customer can settle the invoice by credit card, Paypal or prepayment by bank transfer.
Payments with credit card or Paypal are due immediately. Any fees for payments with the credit card or Paypal are carried by Engelmann Limousinenservice GmbH.

For unpaid credit card debts, Engelmann Limousinenservice GmbH will charge the user for the incurred fees and reserves the right to claim an appropriate processing fee.

A prepayment bay bank transfer is only possible for bookings up to at least 14 days before the agreed pickup time, payable within ten days. The customer carries any transaction fees for payments via bank transfer.

An appropriate penalty fine can be charged for each payment reminder.

§ 3.5 Terms of payment for tours / hourly bookings

In the case of tours and hourly bookings, the final compensation claim will not be made until after completion of the ride in the city of the original pick-up location. Engelmann Limousinenservice GmbH provides the customer with the invoice in general shortly after the end of the ride, but at the latest within 24 hours.

The customer can pay the invoice by cash, credit card, Paypal or bank transfer. For new customers, the payment is due immediately after the journey has ended and can be paid by cash, credit card or Paypal.

Any fees for payments with the credit card or Paypal are carried by Engelmann Limousinenservice GmbH.

For unpaid credit card debts, Engelmann Limousinenservice GmbH will charge the user for the incurred fees and reserves the right to claim an appropriate processing fee.

Payments by bank transfer are payable within ten days after receipt of the invoice, unless otherwise agreed. The customer carries any transaction fees for payments via bank transfer.

§ 3.6. Payment methods for collective invoices

For recurring bookings or events it is possible to combine several bookings on one collective invoice. This possibility is expressly given to the customer by Engelmann Limousinenservice GmbH.

The invoice is payable after reception within ten days, unless otherwise agreed. The billing amount is to be paid without deduction by bank transfer to the bank account specified in the invoice. The customer carries any transaction fees for payments via bank transfer.

An appropriate penalty fine can be charged for each payment reminder.

§ 4 Cancellations

For customers, a cancellation is free of charge if there are more than 24 hours between the receipt of the cancellation and the agreed pick-up time. Cancellations less than 24 hours prior to the agreed pick-up time are subject to a fee, even if the customer is not at fault. One-way transfer services canceled too late are to be paid for in full, for tours / hourly bookings the first hour of the chosen vehicle category will be fully charged. Cancellations can only be made in writing.

§ 5 Changes to bookings

Changes to bookings are generally treated as new bookings. The policy governing the handling of cancellations (§ 4) apply accordingly for the originally agreed booking. A compensation claim by Engelmann Limousinenservice GmbH for the originally agreed booking can remain accordingly.

§ 6 Code of Conduct and Liability of the Customer

The regulations of the road traffic regulations apply to all passengers during the entirety of the ride. The instructions of the driver must always be followed.

Passengers who do not comply with the driver's instructions despite an admonition may be exempted from the vehicle if the disregard of instructions poses a risk to the safety and good order of running operations, their own safety or the safety of the driver. In this case, the termination of the transport does not require a separate notification and Engelmann Limousinenservice GmbH retains the full compensation claim.

The carriage of children must always be requested when ordering the vehicle and the number, age, size and weight of the children should be stated as an additional comment in order to ensure the availability of the child restraint systems. If this information has been missed, the driver can refuse carriage and Engelmann Limousinenservice GmbH retains full compensation in this case.

Smoking and consumption of food is prohibited in the passenger compartment of the vehicles. The customer is liable to pay the costs resulting from the removal of excessive impurities and / or any damage to the vehicle caused by its passengers.

§ 7 Warranty and liability

Engelmann Limousinenservice GmbH is liable for damages caused either intentionally or due to gross negligence. In the event of damage caused by simple negligence, Engelmann Limousinenservice GmbH is liable only for breach of fundamental contractual obligations and only for foreseeable and typical damages. Fundamental contractual obligations are those which, when fulfilled, enable the proper execution of the contract and which the customer can expect to be fulfilled.

However, Engelmann Limousinenservice GmbH is not liable for the impossibility of the service, as far as these were caused by force majeure or other unforeseeable events at the time of the conclusion of the contract and no intentional or grossly negligent action exists. Engelmann Limousinenservice GmbH will notify the customer of such circumstances immediately after becoming aware of them.

All eligible claims for non-performance of our services by Engelmann Limousinenservice GmbH must be present in writing, within three working days after completion of the order.

§ 7.1 Liability for online booking portal

Engelmann Limousinenservice GmbH is not liable for the accuracy, reliability, completeness or timeliness of the online booking portal, nor for damages arising therefrom, unless such damages were caused intentionally or by gross negligence by Engelmann Limousinenservice GmbH.

This applies to all types of damages, in particular due to errors or interruptions in the transmission, or problems with technical equipment and services, incorrect content, loss or deletion of data, viruses or in any other way due to the use of the online booking portal.
Engelmann Limousinenservice GmbH is also not liable for the availability and functionality of the offered features.

§ 8 Entirety and written form

These general terms and conditions are the entire agreement between Engelmann Limousinenservice GmbH and the customer. There are no subsidiary agreements. Changes and additions to this agreement require the written form to be effective.

§ 9 Place of jurisdiction

The place of jurisdiction for the parties and for all claims is the company’s seat of the Engelmann Limousinenservice GmbH. Only German law applies.

Due to existing international business relations, these general terms and conditions are also available in English. In the case of deviations resulting from the translation, the German original version shall take precedence over the English.
